Trial to begin in English-only case
Tuesday, August 12th, 2008Sphere: Related ContentWichita, Kansas (Story Link) — A lawsuit filed by three Hispanic families against the Catholic Diocese of Wichita challenging a policy that requires students to speak only English while at school goes to trial in federal court today.
“What happened at that school constitutes race discrimination under federal anti-discrimination laws — that is why it is important. That needs to be stopped,” said Christopher McHugh, the attorney representing three 12-year-old students named as plaintiffs in the civil litigation.The lawsuit seeks an end to the policy and asks for an order barring similar policies at other Catholic schools in the Wichita diocese.
The plaintiffs are claiming the policy violates the Civil Rights Act and another federal statute by intentionally discriminating against the sixth-grade students and causing a hostile educational environment.
The diocese contended in court filings that the English-only rule is not discriminatory and did not cause a hostile environment. It contends the rule was implemented at St. Anne Catholic School as a legitimate response to inappropriate behavior by a few middle school students.
“This case is about a matter of discipline,” Jay Fowler, the attorney representing the Catholic Diocese said Monday. “Catholic schools embrace all cultures.”
The lawsuit also seeks the return of one student to the school who was allegedly kicked out for refusing to sign the “English only” pledge. And it asks for court and attorney costs and unspecified damages for discrimination and emotional suffering.
“We have seen it tried in public schools before,” McHugh said. “The problem public schools have is that it is a First Amendment issue — so public schools haven’t been very successful.”
Fowler said this case is not a First Amendment issue.
“This is not a case that implicates constitutional or statutory rights, as no court has recognized a right to speak a foreign language at school,” the defendants said in court documents.
DEMOCRATS Want to Stop Immigration-Enforcement Raids
Wednesday, July 30th, 2008Sphere: Related Content(CNSNews.com) - Immigration reform advocates, including Democrats on the House Judiciary Committee, are calling for an end to Immigration and Customs Enforcement raids at businesses that knowingly hire large numbers of illegal aliens.
Meanwhile, a report published Tuesday by a Washington think tank shows that raids, along with other enforcement measures, are doing exactly what they are supposed to do: reducing the number of foreigners illegally working and residing in the United States.
The report, authored by Dr. Stephen Camarota of the Center for Immigration Studies (CIS), says that the illegal-alien population in the United States has declined by more than one million persons in the past year.
CIS looked at a number of possible causes for the decline and concluded that increased enforcement measures have discouraged new illegal immigration and encouraged illegal aliens already here to ‘self-deport’.
“If the decline were sustained, it would reduce the illegal population by one-half in the next five years,” the report concludes.

The San Francisco Chronicle’s Jaxon Van Derbeken has done excellent work this past week exposing the abject stupidity, recklessness, and fecklessness of SF Mayor Gavin Newsom’s open-borders administration. Van Derbeken’s reporting was so devastating and so solid that the p.c. editors at his newspaper who initially refused to call the illegal alien drug-dealers illegal (they were referred to as “migrants”) finally relented and used the forbidden word in the headline of Wednesday’s story on Newsom’s finger-pointing news conference. Amazing.
It’s only a matter of time, of course, before the multiculti mob fights back and demands its quota of sympathetic sob stories from the SFChronicle to make amends for–gasp–reporting on illegal alien criminals and the government officials who aid them.

Sphere: Related ContentA couple of years ago I watched a report on Univision or Telemundo (I forget which at this point) where the reporter interviewed a woman, an illegal alien from a Central American country.The woman, who apparently was not employed, lived in a grand style. She was youngish (late twenties - early thirties?) and good looking, nicely dressed.Her apartment looked like something out of the Pottery Barn catalogue. When asked about how did she earn the money for living in such style, she actually stated that she had done it by charging it to stolen credit cards. She felt that she was owned that lifestyle and had every right to take was she felt was her due.
By the time the report was over I was furious. There had to be hundreds like her. Unfortunately I didn’t have the time or resources to investigate.

What happened to the La Raza/The Race earmark?
Friday, May 9th, 2008Here’s an update on the La Raza/The Race $25 million earmark that had been tucked into Barney Frank’s massive housing bailout bill. (Previous coverage here and here.)It was stripped out of the final version of the bill that passed the House yesterday. But that doesn’t mean they won’t get their money:
The original bill directed $100 million to four community groups, including $25 million each for housing programs run by the National Council of La Raza and the Urban League. Republicans balked, saying the money was meant to help Democrats in an election year.
The language was stripped out before the bill came to the floor. But La Raza, the Urban League and scores of community organizations are still in line for housing-development money, plus $230 million for the remainder of this year and another $230 million for fiscal 2009 for mortgage counseling.
“It’s a political-ally slush fund,” said Rep. Jeb Hensarling, (R., Texas), chairman of the conservative Republican Study Committee, which opposed the package.
As I’ve reported previously, the left-wing mortgage counseling racket is and will continue to be well-funded by the Dems while Republicans sit back and do nothing.

Sphere: Related Content(link) DOVER, N.J. - New Jersey’s top federal prosecutor told a Latino group it’s a civil offense _ not a crime _ for immigrants to live in the country without proper documentation, a comment that a spokesman later said was aimed at a narrowly worded question.U.S. Attorney Christopher Christie, widely considered to be a leading GOP contender for governor next year, spoke Sunday in response to a question on illegal immigration at an open forum that grew heated. He said living in the U.S. without immigration paperwork is “an administrative matter” that federal immigration officials are supposed to address through deportation.
“Don’t let people make you believe that that’s a crime that the U.S. attorney’s office should be doing something about,” Christie was quoted as saying in The Star-Ledger of Newark for Monday editions. “It is not.”
Christie stressed that lacking immigration documents is not a crime unless the person was previously deported.
Critics quickly categorized Christie’s remarks as soft on illegal immigration.
In a statement clarifying the remarks, Christie spokesman Michael Drewniak said that although lacking documents is not necessarily a crime in itself, it is a federal misdemeanor to enter the country without going through the proper immigration channels, or to enter by using fraudulent documents.
Christie “did not say, nor did he mean, that entering this country through any means other than the appropriate immigration channels is a lawful act. It is not,” Drewniak said in a statement.
An immigrant could be in the country illegally without making an illegal entry or using fraudulent documents if he or she overstayed a visa.
Christie, who was appointed by President Bush in 2001, made the remarks during a community forum organized by the Latino Leadership Alliance of New Jersey.
He told the audience it doesn’t take a “genius” to see there’s a serious immigration problem in this country and that the U.S. needs tighter border security.
“If there are people out there committing crimes, they should be dealt with,” he said. “If there are undocumented people running around, then Immigration and Customs Enforcement should do their jobs.”
Edward Correa, a member of the Latino Leadership Alliance, said the dozens of people who attended Christie’s speech had a mixed reaction to his comments.
In 2005, U.S. Rep. James Sensenbrenner introduced legislation to criminalize any undocumented status. Though the attempt was unsuccessful, it triggered massive pro-immigrant marches across the nation.

Federal prosecutors today charged members of the Latino Florencia 13 street gang with racially motivated crimes against African Americans, including several attempted homicides.Authorities said the gang specifically tried to eliminate rival African American gangs in South L.A. and the Florence-Firestone area in an effort to “cleanse” the neighborhood. In doing so, they mistakenly harassed and attacked innocent African American residents, according to the indictment.
More than 60 members and associates of the Florencia 13 street gang were charged with federal racketeering and drug charges.
“In their attempt to intimidate African Americans in the community, they targeted innocent citizens,” U.S. Attorney Thomas P. O’Brien said.
O’Brien said the arrests were the result of a nearly three-year investigation into the gang that culminated in federal indictments at the end of the summer.
The arrests come as both local and federal officials have launched a crackdown on race-motivated gang crime across L.A. Authorities have already filed charges against a different Latino gang in the Harbor Gateway area accused of crimes against African Americans, including the slaying of a teenage girl last year.

The parents of murdered high school student Jamiel Shaw met with L.A. public officials yesterday, urging them to rescind the city’s notorious Special Order 40–one of the nation’s oldest illegal alien sanctuary laws. Enough is enough:
The parents of Jamiel Shaw Jr., a high school football star who was gunned down by a reputed gang member just blocks from his home, urged Los Angeles city leaders today to go after criminals who are in the country illegally.
Pedro Espinoza, 19, allegedly shot and killed the 17-year-old Los Angeles High School student on March 2 in the 2100 block of Fifth Avenue, not far from the Shaw family’s Arlington Heights home. According to police, the shooting occurred one day after Espinoza was released from county jail, where he was serving time for assault with a deadly weapon.
U.S. immigration officials believe Espinoza, a member of the 18th Street gang, may have been in the country illegally.
“We have a problem with the system. My son was murdered by someone that was here illegally. No matter how you look at it, that’s what happened,” Jamiel Shaw Sr. told reporters before entering the Los Angeles City Council chamber.
Authorities do not know why Espinoza was not detained by U.S. Immigration and Customs Enforcement upon his release from the county jail.

One thing Barack Obama, Hillary Clinton and John McCain all have in common is that they voted to give retroactive Social Security benefits to illegal aliens who committed document fraud.Indeed, McCain voted for it before he was against it.
On May 18, 2006, when the immigration reform proposal advocated by McCain was on the Senate floor, Sen. John Ensign of Nevada offered an amendment.
As written, the bill immunized illegal aliens from being prosecuted for document fraud, including using a stolen, or a fake, Social Security number. Additionally, the bill did not stop the current practice of allowing aliens who are eventually granted permanent legal residency to go back and claim credit with the Social Security Administration for work they did as an illegal.
Thus, the immigration reform proposal advocated by McCain in 2006 would not only have added millions of illegal aliens to Social Security rolls, it would have protected these aliens from being prosecuted for fraudulently using other people’s Social Security numbers.
Don’t mind this tho… because McKein will unite the conservatives…
There are obviously some folks who have been suckered into buying into McKein’s bullshit, but the operative question for you McKein supporters is ‘Who needs a weird old coot in the White House?’

I watched his speech and still was not impressed. Although GOP party insiders, desperate to keep the party intact, will pimp for him as much as possible.
I believe that he feels that all of this opposition to him is manufactured, that we will eventually come around and support him for the good of the party.
So the smug bastard spoke a CPAC and received some bogus applause from paid campaign groupies. Big deal!!
Let me focus on one thing he keeps saying and why I don’t trust his ass for one minute.
“we need to secure the borders” no you don’t, you don’t need a damm fence to keep Mexicans from crossing over. If this man were serious about convincing us conservatives that he is serious about illegal immigration, this is what he would have said;
I understand the seriousness of illegal immigration and the threat it poses to this nation.
As president I will do the following:
1) I will stop the flow of federal dollars to cities that harbor illegal aliens.
2) I will oppose giving automatic citizenship to the children of illegal aliens and foreign visitors.
3) I will work to establish a universal system for checking welfare and work eligibility.
4) I will propose that stiff fines be levied at companies that hire illegal or undocumented immigrants.
5) I will oppose any legislation that seeks to grant drivers licenses to illegal immigrants.
6) I will instruct local authorities to report to federal authorities any criminal offense perpetrated by an illegal immigrant.
7) I will end all public benefits for illegal aliens.
8) I will make alien smuggling and document fraud a federal offense.
But who am I kidding McCain won’t say that shit. He will just keep repeating “border security first” and hope that the public will buy into his bullshit.
Don’t forget that his running mate will likely be Mike “Mexican consulate in Arkansas” Huckabee. McCain seriously must think we all have jackass stamped on our foreheads.

Sphere: Related ContentI have a neighbor named George. He and his family have been great neighbors. We’ve exchanged gifts, attended parties together, helped each other out from time to time with one thing or another. Our kids have been friends. I like them all. They’re really great folks.However, all but the father and one son out of a family of six are illegal immigrants by way of Mexico.
Last year, two of their sons got caught up by immigration and sent back to Mexico. George’s wife moved back to Mexico to be with her sons. George stays here with the eldest boy and their daughter. He works hard and misses his wife. Of course, she cannot come back because she was never a legal resident and has no papers.
It’s all a terribly rotten situation for George and his family and I know that I would be highly upset were I in his situation. But, his situation is not unlike that of millions of other families that have a mixture of legal and illegal members living in the U.S.
And therein lies a problem. Yes it is a problem for them, but it is also a problem for anyone interested in stricter border control and enforcing current immigration laws or creating new ones. And it is a problem that looms larger every single day. It is a problem that is born of our own democratic system: Voting.
You see, once a Mexican national (or other immigrant) becomes a legal, voting resident he comes to have his fair, democratic say in the process. Ordinarily, it is a fine thing that a new citizen exercises his newfound duty to become a voter as a new member of our society. But, in this case, if that new voter has illegal immigrant family members, he comes to the polls with a built in prejudice against U.S. sovereignty and border control.
In essence, when asking a newly legalized U.S. citizen to vote on tougher immigration laws, we would be asking him to vote to allow his mother, father, sister or brother to be deported. By asking for this new voter to vote on stricter border laws, we are making it tougher for his extended family, should they be illegals, to visit and work here.
Illegal immigrants may get rebates… of course they vote!! McCain….

In their bipartisan zeal to quickly cut a deal on an economic stimulus bill, GOP lawmakers overlooked something that will certainly inflame the conservative base _ illegal immigrants could receive a tax rebate check from the government.The text of the House passed bill contains language making “non resident aliens” _ illegal immigrants _ ineligible for the tax rebates. But every year, hundreds of thousands of undocumented immigrants use individual taxpayer identification numbers, known as ITINs, to file income tax returns with the IRS. These ID numbers are used instead of Social Security numbers. There are no exact statistics for how many illegal immigrants file tax returns, but this New York Times story from last year details the significant increase in use of ITINs. This story also lays out the issue.
Immigration advocates point out that many legal immigrants use ITINs, so it would be impossible to outlaw rebates for everyone who uses this form of ID in tax returns.
Republicans who were involved in negotiating the bipartisan economic stimulus package would like to avoid the illegal immigration debate as the $146 billion bill comes to the Senate this week. Congressional aides say the problem is that the IRS is not a law enforcement agency, so it doesn’t check immigration status when people file tax returns.
“The reality is that those who filed a tax return will be eligible” for tax rebates of $600 to $1,200, said Sen. Ken Salazar (D-Colo.). “This [issue] has not been addressed” by the senators writing the bill.
The issue has certainly caught on in the conservative blogosphere, though, and you can bet a few conservative senators will bring this up as the stimulus bill hits the Senate floor. CNN’s Lou Dobbs will probably have a field day with the issue as well.

That’s a small victory. But questions like this remain: How can McCain honestly reach out to conservatives when he defends his extremist campaign Hispanic outreach director who doesn’t believe in borders and when he boasts a national campaign finance chair and soft-money mogul who poured millions of dollars into the fight against English-language instruction in California, Planned Parenthood, and radical environmental fear-mongering groups?

But Lettuce McCain and the Democrat candidates aren’t too worried about it; they have plenty of heavily armed security.Lacking a functioning government to defend them from foreign incursions, American citizens are literally under siege:
A felony conviction and subsequent deportation didn’t stop Manuel Enrique Morales from crossing the border to return to Mesa, where police allege he and others terrorized victims with an assault rifle in a series of home invasions.
This is hardly unusual. In neighboring Chandler, Arizona, serial rapist Santana Batiz Aceves was finally caught recently. He preyed on children in their homes, and had been deported twice. Erik Jovani Martinez was deported the year before he shot and killed police officer Nick Erfle in Phoenix last September.
This time Morales will sit in jail for awhile. When he gets out, he’ll be deported. Soon afterwards, he’ll be back in the US with his assault rifle or whatever else he cares to bring across the unguarded border.

Hillary Rodham Clinton, he is taking a giant risk: spotlighting his support for the red-hot issue of granting driver’s licenses to illegal immigrants.
It’s a huge issue for Latinos, who want them. It’s also a huge issue for the general electorate, which most vehemently does not. Clinton stumbled into that minefield in a debate last fall and quickly backed off. First she suggested a New York proposal for driver’s licenses for illegal immigrants might be reasonable. Then she denied endorsing the idea, and later came out against them.
Asked directly about the issue now, her California campaign spokesman said Clinton “believes the solution is to pass comprehensive immigration reform.”
“Barack Obama has not backed down” on driver’s licenses for undocumented people, said Federico Peña, a former Clinton administration Cabinet member and Denver mayor now supporting Obama. “I think when the Latino community hears Barack’s position on such an important and controversial issue, they’ll understand that his heart and his intellect is with Latino community.”

While I’m not a big fan of protesting during a speech, there is something to be said for free speech. It shouldn’t include being brow beaten with a now tired response from John McCain. He continues to use an exceptional case to close down debate on illegal immigration. And his temperament in doing it doesn’t really play well at all.If he wants to yell and curse at his colleagues in the Senate, it’s their business if they want to put up with it. But how long before this guy really goes off on someone in the heat of a national campaign?
Mr. Shamnesty-Short Fuse almost walked off the stage during a campaign event with the AFL-CIO in Michigan. Audience members didn’t like his soft-on-illegal immigration blather. They booed.
No angry Johnny I don’t believe you when you say you will secure our borders, and not grant amnesty to illegal folks. You lead this new crop of RINO Republicans who continue to pimp amnesty and think that Mexicans crossing the border and providing cheap labor is good for America.
Why don’t you just tell the voters of Michigan that you would support having all of these Mexicans come up there and work in those auto manufacturing plants to keep them open.
They can produce all of those nice cars and save money because they won’t have to deal with these ungrateful greedy overpaid American workers.

John McCain, one of the leading Republican candidates for president, is thought to be tough as nails because he survived 5 1/2 years of abuse at the hands of the North Vietnamese when he was a prisoner of war.Everyone pays appropriate homage to him for his service to his country, but since he is running for president he also deserves a serious look at his record and his proposals.
And on the subject of enforcing immigration law, McCain is not as tough as nails; he is squishy as a jelly doughnut.
Accused of supporting amnesty in the McCain-Kennedy bill and in subsequent immigration “reform” bills, McCain typically denies it was amnesty because the illegal immigrants had to pay a $5,000 fine, but then he says that under his plan no one would be able to avoid following the law. “There is no special right associated with my plan,” he says.
Except… he always adds a squishy exception.
In one debate, he said he wouldn’t deport the grandmother of a soldier fighting in Iraq because she was illegal. In another, he said he wouldn’t deport the wife of a soldier fighting in Iraq because he was possibly missing in action.
Apparently, McCain believes in “rule of law” unless you have a really compelling story. Then you get a free pass. Call it the Oprah factor. If you can make us cry on a talk show, we like you too much to send you home.

Sphere: Related ContentPHOENIX (Reuters) - Mexican illegal immigrant Lindi sat down with her husband Marco Antonio in the weeks before Christmas to decide when to go back to Mexico.She has spent three years working as a hairdresser in and around Phoenix, but now she figures it is time to go back to her hometown of Aguascalientes in central Mexico.
“The situation has got so tough that there don’t seem to be many options left for us,” Lindi, who asked for her last name not to be used, told Reuters.
The couple are among a growing number of illegal immigrants across the United States who are starting to pack their bags and move on as a crackdown on undocumented immigrants widens and the U.S. economy slows, turning a traditional Christmas trek home into a one-way trip.
In the past year, U.S. immigration police have stepped up workplace sweeps across the country and teamed up with a growing number of local forces to train officers to enforce immigration laws.
Meanwhile, a bill seeking to offer many of the 12 million illegal immigrants a path to legal status was tossed by the U.S. Congress, spurring many state and local authorities to pass their own measures targeting illegal immigrants.
